Will of William Haynes 1781
last will and testiment

 

Bedford County, VA - Will Book 1, page 394

IN THE NAME OF GOD AMENI William Haynes being in the full exercise of my reason and memory (Thanks be to Almighty God) and calling to mind the mortality of my Body -- and knowing that it is appointed for all men to die, do make and ordain this my last Will and Testament.

 IMPRIMIS. I will that out of that Estate with which it hath pleased God to bless me in this life all my just debts be punctually paid and after the payment thereof -- I give devise and dispose of the same in the following manner viz. I give to my son-in-law Stephen Sanders -the Land and Plantation whereon I now live containing 200 acres to him and his Heirs, forever, only reserving to John Otey one acre whereon his Mill now stands provided the said Otey, agreeable to a former bargain-shall keep the said Mill in repair and grind all the grain, the said Sanders shall want for the use of the said Plantation or any other person into whose hands the said Land may fall toll free, and on failure the said Acre of Land is to revert to the said Sanders his Heirs or Assignees.

ITEM. I lend to my Daughter Ann Ferril two Negroes to wit Lucy and Jean during her natural life and at her decease to be equally divided between her two daughters Mildred and Elizabeth, also I give to my daughter Ann Ferril one feather bed and furniture.

 ITEM. I give to my son John Haynes and to my daughter Frances Smith one Negro boy Peter to be equally divided among them.

ITEM. I give to my daughter Elizabeth Leftwich one Negro boy Ceazer to her and her heirs, also a sorrel horse called Pompey.

 ITEM. I give to my son William Haynes one Negro man named James to him and his heirs.

 ITEM. I give to my daughter Mildred Sanders one Negro woman named Peg to her and her heirs.

 ITEM. I give to my daughter Mary Long one Negro girl named Judith to her and her heirs.

 ITEM. I give to Elizabeth Sanders, oldest daughter of Stephen Sanders and Mildred his wife, one Negro girl named Sall to her and her heirs.

 ITEM. I give to my son Henry Haynes one bay horse and all the residue of my Estate I give to be equally divided between my daughter Elizabeth Leftwich and my son Henry Haynes - giving the said Henry one feather bed and furniture he accounting with the said Elizabeth for the value thereof in the above division.

 And I do constitute and appoint William Leftwich and Stephen Sanders Executors of this my last Will and Testament.

In Witness whereof I have hereunto set my hand and Seal this Eighth Day of April One Thousand Seven Hundred and Eighty.

At a Court held for Bedford County the 25th day of June 1781. This last Will and Testament of William Haynes deceased was proved by the Oaths of Merry Carter and Frances Carter Witnesses thereto Subscribed and Ordered to be Recorded and on the Motion of William Leftwich Gent. One of the Executors therein named who made Oath thereto Certificate is granted him for obtaining Probate in due form giving security whereupon he together with David Wright and Merry Carter his securities entered unto and acknowledged their bond in the penalty of Three Hundred Thousand Pounds for the said Executors due and faithful administration of the said Decedents Estate and performance of his will - Liberty being reserved the other Executor mentioned in said Will to join in the Probate thereof when he shall think fit.
