Botetourt County, Virginia Wills - 1770-1824

In the name of God Aman I thomas Tosh of Botetourt County and colony of Virgin ia being weak in body but of perfect mind and memory thanks be given unto God. Therefore coling unto mind the mortality of my bodey and knowing that is apoynted for all men once to die, mark and ordain this my last will and testament that is to say prinsably, and first of all I give and recomend my soul into the hands of almighty God, that givest and my body I recomend to the Earth be buried in decent Christian Buriel at the [discretion?] of my [Relhife? Relatives?] a nothing doubting but at the general reserection I shall receive the same again by the mighty power of God and constituting such worldly estate where with it has pleased God to bless me with in this life I give demise and dispose of the same in the following rnaner and form I give and bequeath to my dearly beloved wife Mary whilst she remains my widow the plantation where on I now live: with five work hands also six breeding mairs to be taiken out of my hole stock for the use of the plantation. Also ten milch cows also ten head of sheep also the five negroes Sampson, Herry [?], Dave, Pog [?] and Frank also the still and vesals and farming utensals with aIl the household furniture now in my possession with all my stock of hogs which articals above mentioned together with the plantation I vest in my wife Mary for the support of her and my family which I leave at my death during his widowhood and in case of his maring the above named negroes and stock to fall to my son Jonathan and to his heirs forever with the plantation with the incrace of negroes and stock except what will be expanded for the support of my family and it is my desire that my wife will take care of my sones Education and give him proper and sufficient schooling out of the produce of the above estate and in case my son Jonathan should die without having lawful heir of his bodey before my wife then the above plantation and other articles which he was to have been heir of all to be jointly - I give and bequeath to Mary my daughter the foling tracks of lands one track on the North fork of Branaak [?] containing one hundred and sixty three acekers also one track joining the former track containing one hundred. One track in the south side of Broak [?] containing one hundred and sixty acecrs more or less also a negro woman caled Laney [?] and a girl caled Jude also a Roan mare and two other breeding mairs to be taken out of my stock at my death . I give to my daughter Mary one feather bed with furniture for the same. Also I desire to given to Soel [?] Brickey two breeding mairs and two cows and calfes to be given on half stocks for the use of son in law James Craford - also it is my desire that all my debts is to be paid out of the remainder of my estate and the remainder of all to my son and the suport of my wife and family. Also it is my desire to be given to my son in law James Craford one gray mare and colt, also I give and bequeth to my only son Jonathan Tosh all my other lands and [acouterments?] to him and his heirs forever. And that the above may be faithfully executed. I apoynt my son in law James W. Niell [McNiell?] to be sole executors of this my last will and testament and I do hereby utterly disalow and revoke and disanul all other wills and former testaments confirming this and no others to be my last will and testament in witness I have sworn to set my hand and seal this seventh day of September one thousand seven hundred and seventy seven.

At a court held for Botetourt County the 11th day of February 1778 this instrument of writing was presented in court as and for the last will and testament of Thomas Tosh deceased and proved by the oathes of Danl. McNeill, William Corvin and Jonathan Tosh the witnesses being named and ordered to be recorded.
